Lendiago provides a platform that connects small and medium-sized businesses (“Users”) with lenders, funders, or other financial service providers (“Lenders”). Lendiago does not provide direct loans or funding and acts solely as an intermediary.

4. Opt-In Consent for Communications

By providing your phone number during the application or inquiry process, you expressly consent to receive communications from Lendiago and its Lenders via phone calls, text messages (SMS/MMS), and emails. These communications may include informational, transactional, or promotional messages related to our Services. Standard message and data rates may apply.

Opt-Out: You may opt out of receiving promotional messages at any time by following the unsubscribe instructions included in the messages or contacting us directly at info@lendiago.com. However, you may still receive essential service-related communications.

5. Use of Services

You agree to use the Services solely for lawful purposes and in accordance with these Terms. You may not:

• Use the Services to engage in fraudulent or illegal activity.
• Misrepresent your identity or provide false or misleading information.
• Attempt to interfere with the operation or functionality of the Services.

6. Information Disclosure and Authorization

By using the Services, you authorize Lendiago to share your information with Lenders, funders, and brokers as necessary to facilitate funding opportunities. Lendiago does not guarantee loan approval, specific terms, or rates from any Lender.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. Lendiago does not warrant that:

• The Services will meet your specific requirements.
• The Services will be uninterrupted, timely, secure, or error-free.
• The results obtained from using the Services will be accurate or reliable.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LENDIAGO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use of or inability to use the Services.
• Any unauthorized access to or use of our servers and/or any personal information stored therein.
• Any interruption or cessation of transmission to or from the Services.

You agree to indemnify, defend, and hold harmless Lendiago, its affiliates, officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including attorney’s fees) arising from:

• Your use of the Services.

• Your violation of any third-party rights, including but not limited to intellectual property or privacy rights.

Lendiago reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting the updated Terms on our website. Your continued use of the Services following the posting of revised Terms constitutes your acceptance of those changes.

12. Termination

Lendiago may terminate or suspend your access to the Services at any time, for any reason, without prior notice or liability. Upon termination, your right to use the Services will immediately cease.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any disputes arising from or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Delaware.
